Terms & Conditions
These Terms and Conditions govern all registrations for the AM TECH DAY APAC 2025 Conference to be held at Wharf 2 and 3 Hickson Rd, Dawes Point, Sydney, Australia on 11 March 2025 (the Conference) by CapitaHQ Events Pty Ltd ACN 678 599 374(“We”, “Us” or “Our”).
By completing registration and paying the registration fees, the prospective attendee, sponsor, consultant or delegate ("You" or “Your”) agrees to these Terms and Conditions. If you are registering on behalf of others, you are responsible for ensuring that they are made aware of and agree to these Terms and Conditions.
1. Registration
1.1 Payment
All registration fees must be paid in full prior to the Conference and on registration to the Conference. Once the payment is successful, You will receive an email confirmation about your access to the Conference. If payment is not made at the time a registration is lodged, then registration will be deemed provisional, and We reserve the right to deal with such registrations in its absolute discretion, acting reasonably.
All payment amounts are quoted in Australian Dollars (AUD) and are exclusive of GST. Payments can be made via credit card or Electronic Funds Transfer. Accepted credit cards include Visa, Mastercard, and AMEX, and any surcharges applied by the card provider will be Your responsibility.
1.2 Cancellation by Attendee
Notification by You to cancel registration for the Conference may be made in writing and sent to contact@amtechdayapac.com. For cancellations received in writing 90 days before the Conference, We will refund 30% of the registration fee. Any refund will be made via the same payment method as the original receipt of funds.
If cancellations are made within 90 days from the Conference, You will not be eligible for a refund. By proceeding with this registration, You acknowledge and agree that no refunds will be issued for cancellation made within 90 days of the Conference and will retain the full amount of registration fees by way of liquidated damages to cover administrative costs and anticipated expenses associated with the registration cancellation.
1.3 Transfer of Registration
Registrations may be transferred to another attendee or delegate at no extra cost if written notice is provided to contact@amtechdayapac.com and the new attendee or delegate agrees in writing to these Terms and Conditions.
1.4 Special Requirements
You are encouraged to notify Us of any special access or accommodation requirements at the time of registration. Alternatively, these requirements can be communicated via email to contact@amtechdayapac.com no later than 90 days before the Conference to ensure suitable arrangements can be made prior to the Conference.
2. Behaviour and Code of Conduct
2.1 Diversity and Inclusion
We value diversity and inclusion as essential principles and recognise the positive impact that embracing individual differences has on innovation and collaboration. We are committed to creating a Conference environment that is free from discrimination, harassment, or bias based on irrelevant attributes, including but not limited to religion, race, ethnicity, language, gender, sexual orientation, disability, or age.
We reserve the right to refuse registration or to remove any attendees, delegates and sponsors, who fails to uphold or promote these values of diversity and inclusion or behaves in a manner inconsistent with clause 2.2.
2.2 Inappropriate behaviour / intended inappropriate behaviour
At all times during this Conference, You are required to adhere to the Our code of conduct outlined in this clause 2.2. By registering to this Conference, You agree to the following (but not limited to):
a) Conduct in a reasonable, respectful, considerate, and lawful manner at all times;
b) Refrain from acting, speaking, or communicating in a manner that is offensive, obscene, or that reasonable persons might consider offensive or obscene;
c) Avoid placing the safety or health of any individual at risk, including through reckless or negligent behaviour;
d) If consuming alcohol, do so responsibly and within the bounds of the Conference’s policies;
e) Avoid causing personal injury, defaming others, or damaging property;
f) Be respectful toward speakers, staff, and fellow attendees, ensuring You do not disrupt sessions or the event atmosphere.
g) Follow all lawful and reasonable instructions issued by the Our staff, contractors, and venue personnel; and
h) Ensure that any guests or accompanying persons attending the Conference under Your registration also comply with the above requirements.
You must not engage in any prohibited behaviour, which includes any behaviour that is unacceptable or unwelcome. Prohibited behaviour includes, but is not limited to:
a) Direct or indirect actions or words that annoy, alarm, or cause significant emotional distress to another person;
b) Discrimination whether direct or indirect (treating someone unfairly because of race, colour, sex, sexual preference, age, physical or mental disability, marital status, family responsibilities, pregnancy, religion, political opinion, national extraction or social origin);
c) Sexual harassment (unwelcome, uninvited conduct that is offensive from the view of the person harassed, regardless of intent; unwelcome sexual advances, unwelcome request for sexual favours, any other unwelcome conduct of a sexual nature);
d) Physical abuse and uninvited physical contact;
e) Intimidation, threats (implied or real) of any form whatsoever, as well as verbal abuse including any unwelcome or discriminatory comments in relation to an individual;
f) Defamatory comments of any nature;
g) Displaying, sharing, sending or discussing inappropriate material. For instance, offensive words, images or media in any form whatsoever, suggestive comments or jokes of a sexual nature;
h) Disruptive or anti-social behaviour;
i) Consumption or possession of illicit drugs;
j) Inability or unwillingness to conduct oneself professionally, including as a result of drunken behaviour;
k) Any unlawful behaviour of whatsoever nature;
l) Any damage to property at the Conference’s venue of whatsoever nature.
We reserve the right to refuse or cancel a registration, either prior to the Conference or onsite, if You fail to uphold appropriate and professional behaviour under this clause, as determined at Our sole discretion.
2.3 Contravention
Without prejudice to any other rights, We may have, if You contravene any clauses in this Terms and Conditions, We may:
a) Refuse Your entry to, ask You to leave, or remove You from the Conference;
b) Cancel Your registration without refund or compensation; and
c) Disqualify You from purchasing tickets for, or attending, future conferences organised by Us or Our affiliates.
We reserve the right to evict any person from the venue and the Conference if they are found to be in contravention of these Terms and Conditions.
3. Security
For the Safety and security of all attendees and delegates, the following conditions apply to entry and participation in the Conference:
a) You must submit to reasonable security measures, which may include pat-down searches, metal detection, or physical inspections of bags and containers upon entry and at any time during the Conference.
b) Photo identification must be presented when collecting registration passes onsite;
c) To cooperate with security personnel if they have requested You to check bags into onsite cloakrooms at their discretion to ensure a safe environment; and
d) If You fail to submit the required photo identification onsite, We reserve the right to cancel Your registration without refund.
If You refuse to comply with the security measures or identification requirements under this clause, We reserve the right to deny Your entry to the Conference without a refund; or remove You from the venue without a refund if the refusal occurs after entry.
4. Privacy Policy
We are committed to protecting your privacy. We acknowledge and abide by our obligations under the Australian Privacy Principles contained in the Privacy Act 1988 (Cth) (as amended).
4.1 Data Collection
The information collected in the registration form will be retained by Us and Our partners, for the purposes of preparing and carrying out the Conference. The Conference aims to bring together fintech and market professionals from the Asset Management, Superannuation and Wealth industries to:
a) Enhance knowledge of key industry trends, technologies, challenges, and opportunities.
b) Facilitate networking among stakeholders, including developers, investors, policy makers, and other participants in the crypto ecosystem.
4.2 Data Management
In accordance with the Privacy Act 1988 (Cth) (as amended), You have the right to access, rectify, delete, port your data and limit or object to its processing. In particular, You may at any time request not to be/no longer to be contacted via email or message sent by automated system by writing contact@amtechdayapac.com or by contacting the partners directly.
4.3 Data Sharing
On the basis of Our legitimate interest to foster industry collaboration and innovation, the personal data provided by You during registration may be shared with:
a) For purposes of delivering relevant conference-related content, informing You about future events, or presenting opportunities that may be of interest to You.
b) To ensure seamless communication regarding schedules, venue information, and other organisational updates.
c) Other delegates, sponsors, attendees or consultants so that they may easily ascertain who is attending the Conference. For the purpose of this clause 4.3(c), only Your name, job title and company will be shared.
By registering, You consent to being contacted by Our partners and sponsors in relation to the event or related activities and Your date being shared. If You do not wish for Your data to be shared in this manner, please notify Us in writing at contact@amtechdayapac.com prior to the Conference.
5. Speakers, Presenters, Or Facilitators
The views and opinions expressed by speakers, presenters, or facilitators at the Conference are solely their own and do not necessarily reflect Our views.
You acknowledge and agree to indemnify Us against any claims, losses, or damages arising from advice, opinions, or information shared by speakers, presenters, or facilitators during the Conference or in connection with any materials provided to delegates or attendees. We encouraged You to exercise discretion and seek independent advice before relying on or acting upon any information presented at the Conference.
6. Photography and videography/filming
You may use handheld cameras and/or smartphones to take photographs and videos for personal, non-commercial purposes, provided that the activity is not disruptive, intrusive, or in breach of intellectual property or privacy rights. Such photographs and videos must not be published, sold, reproduced, transmitted, distributed, or otherwise commercially exploited in any form.
We may hire service providers (e.g., photo/video/streaming/audio) to document the Conference. Content captured may be used on social media platforms and featured on the Our website to showcase the Conference experience.
By registering, You irrevocably authorise the Us to:
a) Record Your image and voice through photographs, videos, and sound recordings (collectively, “Recordings”).
b) Edit, use, and incorporate these Recordings into photo galleries, promotional videos, short films, webinars, or other media as a record of the Conference or for promoting future conferences.
You acknowledge that You have no right, title, or interest in these Recordings and will not receive monetary or other compensation for their use.
7. Travel and Accommodation
You are solely responsible for payment of Your travel and accommodation costs, and any other costs incurred during their stay. We do not accept any liability for any loss, inconvenience, or damage arising from unsatisfactory accommodation arrangements made by You or provided by a hotel.
8. Force Majeure
We shall not be liable for any loss or damage suffered by You, nor be in breach of these Terms and Conditions, for any delay, failure, or interruption in the delivery of goods and services related to the Conference caused directly or indirectly by events beyond the Our reasonable control. These events include, but are not limited to:
a) Industrial action, blackouts, fire, war, terrorism, civil or military unrest, explosions, earthquakes, floods, labor disputes, or acts of God.
b) Epidemics, pandemics, or public health emergencies.
c) Government restrictions or any other unforeseen or uncontrollable event adversely impacting the Conference.
If the Conference is cancelled due to any of the causes listed above, You acknowledge that Our liability to You will be strictly limited to a refund of registration fees already paid. We shall not be liable for any additional expenses or costs incurred by You, whether direct or indirect, including but not limited to travel and accommodation expenses.
9. Disclaimer
At the time of registration, We have provided the most recent and accurate information available regarding the Conference. However, You acknowledge that the content, schedule, and/or delivery of the Conference are subject to change due to circumstances beyond Our control. We reserve the right to make modifications to the Conference’s program or content as deemed appropriate, without penalty, and in such cases, no refunds, partial refunds, or alternative offers shall be made.
We cannot control all content published, presented, or disseminated during the Conference. You may encounter opinions, materials, communications, or content, that may be inappropriate, offensive, harmful, inaccurate, dishonest, misleading, or deceptive. We encourage You to approach these situations with an open mind, exercise discretion, and engage responsibly to make the most of your experience at the Conference. Your interactions are Your own, and We trust You to navigate them with good judgment and respect for others.
We and Our organisers, directors, employees, agents, and affiliates shall not be liable for any losses, damages, liabilities, claims, or expenses arising directly or indirectly from participation in the Conference. This includes, but is not limited to, reliance on any information provided, personal interactions, or the conduct of other attendees or participants.
By registration to this Conference, You agree to release Us from any liability associated with the Conference.
10. Limitation of Liability
Provisions of the Competition and Consumer Act 2010 (CCA) and other laws in force from time to time in Australia may impose guarantees, warranties, conditions and obligations on Us (“Consumer Guarantee”). If any of Terms and Condition are inconsistent with a Consumer Guarantee, the Consumer Guarantee will apply to the extent of such inconsistency.
To the extent permitted by law:
a) We shall not be liable for any claims, damages, or losses suffered by attendees, including but not limited to injury, theft, fire, accident, or any other cause, except where directly caused or contributed to by our gross negligence.
b) Neither We nor attendees shall be liable for any indirect or consequential damages arising from participation in the Conference, including but not limited to loss of profits, loss of opportunities, or reputational damage.
c) The liability of each party for all claims and losses arising out of or in connection with these Terms and Conditions, whether in contract, tort (including negligence), or any other basis in law or equity, is strictly limited to the amount of registration fees paid or payable for attending the Conference.
11. Governing Law and Dispute Resolution
These Terms and Conditions shall be governed by and construed in accordance with the laws of New South Wales, Australia and courts in New South Wales, Australia shall have exclusive jurisdiction to settle any dispute arising out of or in connection with these Terms and Conditions.
